Abstract

In questo articolo, l’autore presenta la storia della nozione d’asilo, alla ricerca di elementi utili per stimolare la riflessione odierna sul diritto d’asilo. Egli dimostra come l’asilo, ben compreso, è un concetto eminentemente etico e teologico, e conclude che la fine dell’asilo religioso con il sistema vestfaliano fa scaturire una nuova responsabilità dei cristiani per difendere e rafforzare le istituzioni fragili dell’asilo che esistono nell’attuale diritto internazionale e nelle leggi nazionali.

Summary – The Historical and Theological Roots of the Notion of Asylum
In this article, the author presents the history of the notion of sanctuary, seeking useful elements to stimulate today’s reflection on the right of asylum. He demonstrates that asylum, well understood, is an eminently ethical and theological concept, and concludes that the end of religious asylum with the Westphalian system implies that Christians are called anew to defend and strengthen the fragile institutions of asylum that exist in the current international law and in national laws.
